The 31 page lawsuit, filed by attorney John Keith Perry on Friday, claims the couple, Dr. Marcia Bowden and Ira Marche, were treated unfairly by Southaven police officers. The lawsuit said the unfair treatment came in the form of the use of excessive force and an arrest that they said should have never happened. According to the lawsuit, the couple was pulled over for speeding and, after not being able to produce a driver’s license, they were handcuffed and arrested. The lawsuit states that just before Marche and Bowden were taken to Southaven Police Department for processing, Bowden began to feel sick. According to the suit, once they were at the police precinct, her sickness got worse and after waiting a half hour, she was taken to the hospital where she was treated for a stress-induced illness. “The fact that this officer, through his own documents, knew who this person was and would have the gall to just say, ‘Well I was going to take you all into custody, because I don’t like something you said,'” Perry said. The lawsuit said the officer actually knew Marche from ticketing him months prior. According to the suit, Marche was pulled over for not having a Mississippi driver’s license. In the notes on the ticket, it shows he has seen the vehicle in the area for the past nine months. Those charges were dropped and his attorney feels he was targeted by the officer because of those actions.medicine
